Ripple wants the SEC to Produce Documents regarding Bitcoin, Ethereum

Amidst the legal battle between Ripple and SEC, the lawyers of Ripple and its CEO Brad Garlinghouse and co-founder Chris Larsen have requested Judge- Analisa Torres to compel the SEC to produce documents regarding Bitcoin and Ethereum. The regulatory authorities have deemed the two largest cryptocurrencies as “non-security assets.”

Ripple stated that “the economic substance” of its XRP’s transactions doesn’t differ from that of two of the world’s largest cryptocurrencies. In its response, SEC claimed that documents related to Bitcoin and Ethereum were irrelevant to this case.

The payment protocol company also alleged that the SEC is “withholding the evidence” and claimed the fact that SEC told crypto exchanges that XRP was not security is “clear.”    

Based on information gleaned to date, it is clear that sophisticated market participants told the SEC that XRP was not a security and solicited feedback on that position, but not provide a contrary public statement until it filed its allegations in this case in December 2020. Learning all there is to know about these facts (whether through internal or external communications) is relevant to the defence and will be central to the Court’s understanding of several issues critical to the case.

The crypto community might have to wait for some more time to understand the course for XRP as the lawsuit’s events unfold. At the press time, XRP traded at $0.443.
